The paid time off that companies give expectant mothers or new moms to care for themselves and their children is known as maternity leave. The Indian government’s Maternity Benefit Act, 1961, establishes the country’s maternity leave regulations.
Maternity leave under this Act provides expectant mothers with paid time off, additional funds for medical expenses, and breaks to nurse their infants.
The Maternity Benefit Act of 1961 also takes into account the “commissioning mother,” a biological mother who utilizes her egg to create an embryo that is implanted in another woman. Maternity leave is now 26 weeks for all moms, with 8 weeks before birth.
Women who have two or more children are off for twelve weeks, with six weeks off before giving birth. Both commissioning moms and adoptive mothers are eligible for a 12-week leave of absence. If their employers allow it, mothers can work from home during this time.
